Customer Portal

Preamble

These General Terms and Conditions (hereinafter referred to as “T”) govern the use of the Taxi 40100 customer portal between CC Taxicenter GmbH (hereinafter referred to as “CC”), Pfarrgasse 54, 1230 Vienna, and the user of the customer portal. After successful registration and confirmation of the T, the user has the right to use the services offered on the customer portal. By accepting the contract, the user accepts these T and confirms the accuracy of the data they have provided.

1. Subject Matter of the Contract

Customer Portal – Taxi Dispatch Services

1.1. CC provides the customer portal to the user free of charge. The application allows the user to make taxi bookings in real-time or pre-orders directly via the software provided. The user has the option to be matched with the nearest available taxi vehicles. To use the customer portal, the user must be registered with an individual customer account.

1.2. The user enters into a brokerage agreement with CC for the arrangement of taxi services. It is noted that the transportation contract is concluded exclusively between the affiliated taxi company and the user. Claims arising from the passenger transport arranged via the customer portal therefore only exist between the taxi company and the user.

1.3. The fare is calculated according to the applicable Vienna taxi tariff. Surcharges are calculated in accordance with Section 5, Paragraph 2 of the Vienna taxi tariff.

1.4. Furthermore, the user has the option to order taxi vouchers and request estimated prices for taxi rides.

2. Contract Duration and Termination

2.1. The contract for the use of the customer portal and the offered service and brokerage services comes into effect on the date the user accepts the T and is concluded for an indefinite period. The contract can be terminated at any time by either party in writing (email is sufficient) without stating reasons. However, any obligations established up to that point remain in effect despite the deletion and can be claimed by CC.

2.2. Payment for the ride can be made in cash, by credit card, or by invoice.

2.3. CC does not assume any liability toward third parties for the taxi companies or the taxi drivers.

3. Sorgfaltspflichten

3.1. The user undertakes to provide truthful data (username, email address, phone number). The user must refrain from any actions that could lead to an impairment or overloading of the customer portal.

3.2. The user undertakes to take all reasonable precautions to protect access data from unauthorized access by third parties. The user is prohibited from passing access data on to third parties.

3.3. The customer undertakes to notify CC immediately upon becoming aware of the loss, theft, or suspicion of misuse at the email address: office@taxi40100.at.

4. Datenschutz

4.1. Personal data includes all information by which a person can be identified directly or indirectly, e.g., name, home address, email address, date of birth, profession, bank details, etc.

4.2. In the event of registration in the customer portal, CC collects and processes the personal data provided by the customer and uses it for the purpose of contract execution.

4.3. The customer can exercise their rights contained in the GDPR and the Austrian Data Protection Act (DSG) at any time. You can find more details in the privacy policy.

5. Haftung

5.1. CC assumes no liability for damages arising from or during the performance of the transportation service.

5.2. The user is obliged to ensure sufficient funds are in their bank account for payments made via direct debit. If the bank account does not have sufficient funds during a debit attempt by CC, the user must cover the costs resulting from the insufficient funds (in particular, those of the chargeback).

5.3. CC assumes no liability for the processing of cashless payments, particularly for credit card charges or payment processing via PayPal. In the event of incorrect or failed bookings, as well as disruptions during the payment process, the user must contact the payment service provider directly.

5.4. A guarantee for the uninterrupted availability of the customer portal and the functions contained therein cannot be given. However, CC strives for high system reliability.

6. Kosten

6.1. The use of the customer portal services is free of charge for the user. However, the user must bear the costs for the end device, ensure the provision of a stable internet connection, and cover these costs.

7. Supplementary Provisions

7.1. These T are subject exclusively to the law of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods.

7.2. The place of jurisdiction for all legal disputes arising from or in connection with these T is Vienna.

7.3. All changes and additions to these T must be in writing.

7.4. Should any provision of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision.

7.5. CC reserves the right to change, improve, temporarily suspend, or no longer offer the services provided in the customer portal in a manner reasonable for the user. The user is not entitled to claims for constant or uninterrupted availability of the application. CC has no influence on the actual availability of the arranged taxis and cannot assume any liability for this.
